The Legal Question
Under 18 U.S.C. § 207, Johnson faces:
- A lifetime ban on matters he “participated personally and substantially” in as Acting ICE Director
- The one-year cooling-off period ended July 2024
The question is whether Sabot’s work — facilitating IGSA negotiations between counties and ICE, managing the “federal interface,” coordinating with ICE on inspections and compliance — constitutes the kind of communication with ICE that triggers the lifetime ban. When the former Acting Director of ICE is selling ICE detention services through county intermediaries, the intermediary structure may not provide sufficient legal distance.
Significance
Johnson is the most senior ICE official to move directly into the private detention-consulting space. His presence at Sabot signals to sheriffs that the firm has genuine insider knowledge and ICE relationships — which is exactly the point, and exactly the concern.
